🌍 Nursing & the Law

The law is a system of rules society creates and maintains to protect people and property. For nurses, understanding law is CRITICAL as it defines your practice boundaries and protects both you and your patients.

📌 Importance of Law to Nurses:

  • Protects public from unqualified practitioners
  • Defines your scope of practice (what you CAN and CANNOT do)
  • Protects patients from legal risks
  • Helps you deal with legal threats effectively
  • Enables licensing, revocation for gross incompetence/negligence

📚 Categories of Law

1. Criminal Law ⚖️
Conduct offensive to society. Prosecuted by the state.
Example: Nurse arrested for stealing drugs → Uganda vs. The Nurse
2. Civil Law 📄
Rights of private individuals. Patient sues for compensation.
Example: Negligent treatment causing harm → Patient sues Nurse
3. Tort Liability/Wrongful Acts 🚨
Punishable acts. Two types: Intentional & Non-intentional (Negligence)

🚫 Intentional Torts (CRIMINAL OFFENCES!)

⚠️ Common Intentional Torts:

  • Assault: Threatening/treating without consent. Example: Giving injection after patient refused
  • Sexual Assault: Any sexual harassment of patients
  • False Detention: Restraining without legal justification. Example: Wrongful isolation
  • Fraud: Misrepresenting qualifications for licensure

💉 NEGLIGENCE (BIGGEST EXAM TOPIC!)

Deviation from standard of care resulting in HARM. This is NON-INTENTIONAL TORT.

🚨 Examples of Negligence (MEMORIZE!):

  • Wrong medication, wrong dose, wrong route, wrong concentration
  • Wrong patient surgery/baby exchange in labour ward
  • Exchanging dead bodies in mortuary
  • Failure to communicate patient condition (verbal/written)
  • Poor maintenance of patient records
  • Failure to count sponges/instruments → retained in body
  • Loss/damage of patient property
  • Failure to report child abuse, sexual assault, infectious diseases
🎯 KEY POINT: Negligence = Breach of Duty + Harm + Causation

🚪 Other Legal Issues

Abandonment:

Ending patient care without ensuring continuation at same/higher level. ILLEGAL!

Euthanasia (Mercy Killing):

Taking positive steps to end life = MURDER under Ugandan law

Breach of Confidentiality:

Sharing privileged patient info without consent = PROFESSIONAL MISCONDUCT

👥 Patient's Rights (7 Components)

Understanding patient rights builds trust and collaboration!

  1. 📢 Right to accurate, clear information about health plan
  2. 🆔 Right to know identity of medical personnel
  3. 🤝 Right to participate in decision-making
  4. ❌ Right to REFUSE treatment (with consequences explained)
  5. 👨‍👩‍👧 Right to representation (parents/guardians for minors/incompetent)
  6. 🛡️ Right to respect & non-discrimination
  7. 🔒 Right to privacy & confidentiality

You have rights too! Know them to protect yourself!

  • 🛡️ Right to safe working environment (violence, hazards, infections)
  • 💰 Right to fair treatment & compensation
  • 🚫 Right to refuse unethical/illegal practices
  • 📚 Right to continuing education & professional development
  • 🤝 Right to respect from patients, colleagues, superiors
  • 🎯 Right to acknowledge limitations & decline unsafe duties

Article 29: Code of Conduct

Foundation document for all health workers in Uganda

Article 30: Responsibility to Patients (MOST EXAMINABLE!)

  1. Patient health, safety & interest = FIRST PRIORITY
  2. No action/omission shall endanger patient safety
  3. Provide relevant, clear, accurate health information
  4. Obtain informed consent before treatment (except emergencies)
  5. For minors/incompetent: get consent from guardian/head of hospital
  6. 🤐 CONFIDENTIALITY - no disclosure without written consent, except:
    • Required by law
    • Patient's best interest
    • Public health hazards
  7. Detained persons: maintain strict confidentiality
  8. 🚫 NO bribes from patients/relatives
  9. 🚫 NO abandonment of patient under your care

Article 31: Responsibility to Community

  • Ensure actions don't endanger public safety
  • ⚠️ REPORT health hazards/outbreaks (cholera, Ebola, COVID-19)

Article 32: Responsibility to Institution

  • Abide by workplace rules & regulations
  • Strive to fulfill health unit's mission
  • Maintain proper dress code & professional appearance

Article 33: Responsibility to Law, Profession & Self

  • Observe laws & uphold profession dignity
  • 🚨 EXPOSE illegal/unethical conduct (corruption, theft, negligence)
  • Maintain confidentiality even after patient death
  • Keep high standards through continuing education (CPD)
  • 🚫 NO advertising professional skills
  • 🚫 NO dangerous lifestyles (alcoholism, drug addiction)
  • 🚫 NO support for unscientific practices/cults
  • Must be registered with Uganda Nurses & Midwives Council
  • Know your limits - decline duties you cannot perform safely

Article 34: Responsibility to Colleagues

  • Cooperate & respect each other's expertise
  • Work as team for holistic patient care
  • Support junior nurses and students
